We assume no obligation to update, change or clarify information on the website, in the Services or on any related website, including, in particular, information relating to prices (where applicable), except as required by law. No update date shown on the website, in the Services or on any related website may be taken to indicate that all the information on the website, in the Services or on any related website has been changed or updated.

Section 11 - Prohibited Uses

In addition to other prohibitions set out in the Terms & Conditions, the User is prohibited from using the website, the Services and/or the Content for any unlawful or unauthorised purposes, including in particular: (i) soliciting third parties to carry out or take part in any unlawful acts; (ii) breaching any legal or regulatory provisions; (iii) infringing or violating our intellectual property rights or the intellectual property rights of third parties; (iv) harassing, abusing, insulting, defaming, slandering, disparaging, intimidating or discriminating, including on the basis of gender, sexual orientation, religion, ethnicity, race, age, nationality or disability; (v) submitting false or misleading information; (vi) sending or transmitting viruses, worms or any other type of malicious code that may damage, contaminate or otherwise be used to affect the functionality or operation of the website, the Services or any related website, other websites or the Internet in general; (vii) collecting or tracking the personal data of third parties; (viii) carrying out actions such as spam, phish, pharm, pretext, spider, crawl or scrape; (ix) for any obscene or immoral purpose; or (x) interfering with or circumventing the security features of the website or any related website, other websites or the Internet in general. We reserve the right to terminate your use of the website and the Services or any related website in the event of a breach of any of the prohibited uses.

Section 12 - Disclaimer of warranties: Limitation of liability

To the fullest extent permitted by applicable legal provisions, the Services and all products and services made available to the User through the website are (except where otherwise indicated) provided “as is” and “as available”, and Universidade Católica Portuguesa makes no representation and grants no warranty of any kind, express or implied, in relation to the Services, including as regards their fitness for a particular purpose, title or non-infringement of third-party rights. In particular, Universidade Católica Portuguesa does not warrant to the User (i) that the use of the Services will meet their needs or expectations; (ii) that the use of the website and/or the Services is uninterrupted or timely, that it is available for indefinite periods of time or that it is not liable to be cancelled without prior notice; (iii) that the use of the website and/or the Services is secure or error-free; (iv) that the results or any information obtained from the use of the Services are accurate and reliable; and (v) that defects, if any, in the operation or functionality of any software provided as part of the Services or in the use/viewing of the website will be corrected.

No advice or information, whether oral or written, from Universidade Católica Portuguesa shall be construed as constituting a warranty of any kind, unless expressly stated in these Terms & Conditions.

To the extent permitted by applicable legal provisions, Universidade Católica Portuguesa shall not be liable to the User for any direct or indirect damage or for loss of profits:

(a) Resulting from the use or viewing of the website and the Services (as well as any materials made available). The User expressly agrees that their use of, or inability to use, the website, the Services or any material downloaded or otherwise obtained through the use of the Services and/or the website is at their own risk.

(b) Resulting from (i) any judgement made by the User regarding the completeness, accuracy or existence of any advertisement or of any relationship or transaction with an advertiser whose advertising appears on the Services or the website; (ii) any changes that Universidade Católica Portuguesa may make to the website or the Services or any permanent termination of the website or the Services (or of any features of the Services); (iii) the removal, corruption or failure to store any content or communication data kept or transmitted during the use of the website and/or the Services; (iv) direct or indirect failure to comply with the Terms & Conditions; (v) failure to maintain and keep confidential the User’s password or account details.

The liability of Universidade Católica Portuguesa for any damage or loss of profits relating to the website and the Services, caused by Universidade Católica Portuguesa, its representatives, directors, officers, employees, agents, subcontractors, service providers, staff and licensors, is limited to cases of wilful misconduct or gross negligence. If the User disagrees, in whole or in part, with the website or the Services, or with these Terms & Conditions, the User may only stop using the website or the Services, as the case may be, and request the cancellation of their user account (if applicable).

These Terms & Conditions do not affect any rights granted by applicable law and regulations, which the User may invoke as a consumer, whenever they interact and deal with Universidade Católica Portuguesa in that capacity.

Section 13 - Indemnification

The User agrees to indemnify, defend and hold harmless Universidade Católica Portuguesa, as well as our related entities, representatives, directors, officers, employees, agents, subcontractors, service providers, staff and licensors, against any claim or demand for compensation, including reasonable attorneys’ fees, brought by a third party, due to or arising from the User’s breach of these Terms & Conditions.

Section 14 - General Provisions

Exercise of rights

Failure by Universidade Católica Portuguesa to exercise any right or to require compliance with any rights or provisions of these Terms & Conditions shall not be deemed a waiver of those rights or provisions.

Invalidity

If any provision of these Terms & Conditions is declared illegal, invalid or unenforceable, the affected part shall be deemed not to form part of these Terms & Conditions, and the validity and enforceability of the remaining provisions shall not be affected.

Section 15 - Applicable Law and Jurisdiction

These Terms & Conditions and any individual contracts under which Services are provided shall be governed by and construed in accordance with Portuguese Law.

Any dispute or litigation arising from or relating to the application or interpretation of these Terms & Conditions shall be submitted to the courts of the District of Lisbon, without prejudice to applicable mandatory provisions. Universidade Católica Portuguesa may, however, seek the application of interim measures (or other equivalent means of urgent legal action) in any jurisdiction.
